Draft — not reviewed by legal counsel
This page lays out the sections a Terms of Service typically needs, with placeholder language, so nothing is missing structurally. It is not a substitute for review by a lawyer licensed in your jurisdiction before this product is offered to real customers — especially the call recording, telemarketing, and liability sections below.
By creating an account or using Ringify (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to the organization that registers for an account ("you," "your organization") and to any team members you invite.
Ringify provides an AI-powered inbound calling agent, website chat widget, and social media messaging assistant, along with related dashboard, CRM, and reporting features. Features available to you depend on your subscription plan and any usage limits described on the pricing page.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, including actions taken by team members you invite. You must provide accurate registration information and keep it up to date.
Paid plans are billed on a recurring basis through our payment processor. Fees are non-refundable except as required by law or stated otherwise. Exceeding your plan's call-minute, message, or seat limits may result in service restrictions or additional charges as described on the pricing page. You may cancel at any time; cancellation takes effect at the end of the current billing period.
This is the section most in need of real legal review. The Service can record and transcribe phone calls handled by your AI agent. Recording laws vary by jurisdiction — some require all-party consent before a call is recorded. You are solely responsible for configuring your agent to provide any legally required disclosure or consent, and for complying with applicable telemarketing, robocall, and do-not-call regulations (e.g. TCPA in the United States) in every jurisdiction you operate in. Ringify is not responsible for your compliance with these laws.
You may not use the Service to make unsolicited or unlawful calls or messages, to harass or defraud any person, to transmit malware, or to violate any third party's rights. We may suspend or terminate accounts that violate this section.
Our collection and use of your data, and data about your callers and website visitors, is described in our Privacy Policy, which is incorporated into these Terms by reference.
The Service relies on third-party providers (telephony, speech processing, language model, email, and payment providers) to function. Your use of the Service is also subject to those providers' terms where applicable, and Ringify is not responsible for their availability or performance.
Ringify retains all rights in the Service, its software, and branding. You retain ownership of the content you upload (knowledge base material, prompts, recordings) and grant us a license to process it solely to provide the Service to you.
The Service is provided "as is" without warranties of any kind. AI agent responses may be inaccurate; you are responsible for reviewing agent configuration for your use case. To the maximum extent permitted by law, Ringify's aggregate liability for any claim relating to the Service is limited to the amount you paid in the 12 months before the claim arose.
Either party may terminate this agreement as described in your subscription plan, or immediately if the other party materially breaches these Terms. Upon termination, your access to the Service ends and data may be deleted per our data retention practices.
We may update these Terms from time to time. Material changes will be communicated via email or in-app notice before taking effect.
